How Wert-Berater, Inc. collects, uses, protects, and discloses information submitted through this site and its client portal.

Effective date: June 11, 2026. This Privacy Policy describes how Wert-Berater, Inc. (“the Firm,” “we”) collects, uses, and protects information submitted through www.wert-berater.com and its associated client portal.

1. Information We Collect

We collect information you provide directly: name, title, organization, email address, phone number, postal address, project descriptions, and documents you upload through our secure intake. When you execute our electronic mutual non-disclosure agreement, we additionally record your typed electronic signature, the date and time of execution, your IP address, and browser identification, which together form the execution record of the agreement. When you request a scheduling window, we record your requested date, time, time zone, and meeting length. We also collect limited technical information automatically through analytics (see Section 4).

2. How We Use Information

Information is used to respond to inquiries, prepare fee quotes, execute and retain non-disclosure agreements, schedule conversations, evaluate and prepare independent feasibility studies, and send transactional confirmations you have requested. We do not sell personal information, and we do not use submitted project information for any purpose other than the engagement it concerns.

3. SMS Communications (TCPA Consent)

If you check the SMS opt-in box on a form and provide a U.S. phone number, you consent to receive transactional text-message confirmations from Wert-Berater, Inc. related to your specific submission. Message and data rates may apply. Message frequency is limited to confirmations of your own requests; we do not send marketing texts. You may opt out at any time by replying STOP, and may obtain help by replying HELP or contacting us at the address below. Consent to receive texts is not a condition of any purchase or engagement.

4. Cookies and Analytics

The site uses Google Analytics to understand which pages are visited and which forms are used, so we can improve the site. Analytics involves cookies and the collection of usage data (pages viewed, approximate location, device type) by Google under its own privacy terms. You can limit analytics collection through browser settings or Google’s opt-out tools. We do not use advertising cookies and the site carries no third-party advertising.

5. Disclosure of Information

The Firm’s professional fiduciary duty runs to lenders, certified development companies, and government agencies. Consistent with that duty and our standing confidentiality practice, project information you submit may be disclosed to the lender, CDC, or agency involved in the contemplated financing. We may also disclose information when required by law, regulation, or compulsory legal process, and to service providers (such as our hosting provider and, where activated, our SMS carrier) strictly as needed to operate the site. We do not otherwise disclose your information to third parties.

6. Retention and Security

Uploaded documents and executed NDAs are stored in access-controlled directories that are not publicly readable, are accessible only to the assigned analytical team, and are retained in accordance with our document-retention practice and applicable legal requirements. Reasonable administrative and technical safeguards are applied; no internet transmission is perfectly secure, and submissions are made with that understanding.

7. Your Choices and Rights

You may request access to, correction of, or deletion of your personal information, subject to records we are required to retain (including executed agreements). California residents may exercise applicable rights under California law. Requests may be directed to the contact below and will receive a response within a reasonable period.

8. Children

The site is a business-to-business service and is not directed to children under 16; we do not knowingly collect their information.

9. Changes and Contact

Material changes to this policy will be posted on this page with a revised effective date.
